W2012-5 Application re subdivision (one new lot) to construct dwelling, well, & septic on 4.8 acre lot 224 River Road (Map 19 Lot 22 Zone R80) Owner/Applicant: Kenneth Golden (Received February 13, 2012 decision by April 9, 2012)
The commission reviewed the plans. T. Gutowski had done a site walk and said the area is extremely tight for a house and septic. A discussion was held on the upland review area. S. Yorgensen was not able to review the application prior to the meeting but said it is a proposed re-subdivision and there is enough buildable acreage to meet the zoning regulations.
A discussion was held on the common driveway. A discussion was held on the plans in regards to relocating the driveway; moving it 30 feet toward the sideline. T. Gutowski asked when the lot was approved and S. Yorgensen said 1981 was the last revision.
The commission looked at the proposed easement and the existing and proposed driveways.
T. Gutowski motioned to approve W2012-5 (plan date of 1/19/12) with following conditions:
- Applicant is required to come back before the commission with any modifications to the site plan.
- The driveway to be built as proposed; 25 feet from the sideline and to be a shared driveway.
K. Metzler seconded the motion. All in favor. Motion carried.
W2012-10 Application for Timber Harvest at 200 Village Hill Road (Map 47 Lot 25 Zone R80) Owner: John Kulo Applicant: Brian Riendeau (Received March 12, 2012 Decision by May 7, 2012)
Brian Riendeau presented a cut plan. He said the property is flat and showed the landings on the map. The site is approximated 8 acres with 2 acres to be logged; it will be a selective cut 14 inches and up on all species. Mr. Riendeau said they will cut almost all the way up to the house and showed the area on the plans. He said he did not see any wetlands when reviewing old survey maps.
K. Metzler asked the timeline for the work and Mr. Riendeau said it would take 2 to 3 weeks. He said it has been logged before and has existing logging roads. K. Metzler asked if he had photographs of the property and Mr. Riendeau said he did not. T. Gutowski questioned the waterbars on the plans and Mr. Riedeau said he put them on the plans in case they find the necessity to use them.
S. Yorgensen asked how close they are to the property line and Mr. Riendeau said right would like to work right up to the property line told the commission he will notify the neighbors.
The commission will conduct a site walk Saturday, April 14, 2012 at 8:00 a.m.
W2012-11 Application for Timber Harvest at 329 Moose Meadow Rd (Map 41 Lot 3A Zone R80) Owner: Wallace Brenger Applicant: Brian Riendeau (Received March 12, 2012 Decision by May 7, 2012)
Mr. Riendeau said they will are proposing a Timber Harvest from Wallace Brenger’s property and onto Brenda Webber’s property. They are currently doing a Timber Harvest on the Webber’s property.
Mr. Riendeau said they are going to put a portable bridge down and pull it up when done. The commission looked at the plans. K. Metzler asked how close to the marsh areas and Mr. Riendeau said maybe 75 to 100 feet and that they will be logging 14 inch and up of mixed species and hardwood. T. Gutowski asked the timeline and Mr. Riendeau said approximately 2 to 3 months depending on the weather.
A discussion was held on the bridges in regards to major storms events and Mr. Riendeau said they are pretty stable and the bridges will float. A discussion was held on the bridge and the crossing. K. Metzler asked how close they will be from the river and Mr. Riendeau said 15 to 20 feet.
The commission will conduct a site walk on April 14, 2012 at 9:00 a.m.
W2011-51 Application for construction of travel stop, including store, food service, fueling station and associated construction west of Polster Road & north of Lohse Road at the intersection of these roads (Map 46 Lots 16 &17 Zone) Owner: Frank W & Joseph Malack Applicant: Love’s Travel Stops & Country Stores (Received November 14, 2011 Public Hearing January 9, 2012 continued February 13, 2012 continued March 12, 2012 continued to April 3, 2012 Decision by May 7, 2012).
D. Schreiber said the commission will not make a decision tonight as they have until May 9th and will take the time to review all the documents.
A letter received from Jacobson and Associates was received 4/9/12 and discussed. The commission reviewed the letters from Jacobson and Associates and the meeting minutes.
T. Gutowski said the applicant did a good job addressing each and every concern the commission members raised. The commission engineer’s has also reviewed the application, submitted comments which were also addressed by the applicant. She expressed her concern on the urban species and would like biological monitoring of vernal pool D; the activity is very close the area. If approved, T. Gutowski would like very close monitoring of the area, someone on site as the construction is going on. She said the engineering was complex and is quite an achievement but one of her concerns is the magnitude of the side walls.
K. Metzler said he would like to see very clear monitoring documents on the catch basins, the oil/water separators, the vortex units, and detention basins. This will be covered by DEP’s permits but as a commission, they need to have all of their documentation in place as well. K.Metzler would like to see an engineer on site during construction of the detention basins and retaining walls. The ground water needs to be well monitored; the diversion needs to be monitored as he is concerned about potential for failure. K. Metzler said there needs to be clear documents on snow removal and the chemicals to be used for de-icing. S. Yorgensen said she would like sodium chloride excluded.
K. Metzler said erosion and sedimentation control during construction needs to be very detailed and regulated; he would like very clear documents.
A discussion was held on the bond and the commission agreed they would like one for sedimentation and erosion and one for plantings. A discussion was held on the as-built. S. Yorgensen would like the elevations on the asbuilt.
K. Metzler said, if approved, he would like any modifications during construction to come back before the commission. T.Gutowski would like the applicant to come back before the commission on any modifications made to the site plan during the P & Z process.
K. Metzler would like the commission to compose a letter to Planning and Zoning regarding their concerns that were not the charge of the Inland Wetland Commission.
S. Yorgensen asked if the commission would like a Spill Prevention and Maintenance plan to come back before the commission and they would. T. Gutowski would like baseline monitoring during construction and annually monitoring every 2 to 3 years. A discussion was held on DEP monitoring of water in the detention basins and the commission would like copies of everything monitored by DEP.
K. Metzler would like vernal pool monitoring 3 to 5 years out; 1 year up to 3 years, skip a year and then monitoring at 5. A discussion was held on ground water testing. A discussion was held on the conservation easement.
K. Metzler would like groundwater monitoring in groundwater infiltration areas; the edge of both parking lots and down the slope to the retaining wall.
T. Gutowski said she is concerned about trucks turning on Polster Rd and would like it included in the letter to P & Z.
A discussion was held on the bonds with the commission suggesting the following: one for erosion control, one for plantings prior to the CO and one for detention basins and retaining walls.
A discussion was held on Love’s Travel Stop and the maintenance of the pavement. . A discussion was held on the chemicals to be used for snow removal.
The commission will continue to review the application. Decision by May 7, 2012.
W2012-4 Notice of violation: Matthew & Amy Michanczyk conducting activities at 23 Lindsey Lane in violation of the Inland Wetlands & Watercourses Act (section 22a-36 through 22a-45 of the Connecticut General Statutes) and the Inland Wetlands and Watercourses Regulations of the Town of Willington. W2012-21 Application for dredging & maintenance of bofilter detention pond at 327 Ruby Road (Map 42 Lot 45 Zone DC) Owner: Royce Properties, LLC Applicant: TravelCenters of America, LLC (Received April 9, 2012 Public Hearing or decision by June 11, 2012)
The commission would like the applicant to come before the commission and the commission will then conduct a site walk following the presentation of the application. .
W2012-23 Application for road and drainage improvements on Turnpike Rd from intersection Fermier Rd & Balazs Rd ½ mile eastward to the Ashford line. (Phase 1) Owner/Applicant: Town of Willington (Received April 9, 2012 Public Hearing or decision by June 11, 2012)
Karl Acimovic presented plans. He said there is an issue with safety and water quality. A discussion was held on the plans. The proposal is to line the existing pipe and put in a box culvert which will go under the road rather than over the road. He said this application is for drainage only and the flows will continue to go as they are now. Mr. Acimovic said they will be replacing some of the catch basins and will continue to clean them once a year. A discussion was held on the points of discharge.
Mr. Acimovic said they would like to do the work as soon as possible and to have it completed by winter. He said they would only work temporarily in the wetland area and the wetlands have been flagged by John Ianni. This application is tabled until May 7, 2012.
W2012-26 Application to construct a 18.5’ X 26’ deck behind house 42” above grade from the Fenton River at 143 Daleville Rd (Map 12 Lot 17 Zone R80) Owner/Applicant Muriel Jax (Received April 9, 2012 Public Hearing or decision by June 11, 2012)
Ms. Jax was present and said she would like to add a deck to her house. She said an addition was added in 1993 and discussion was held on the location of the house and the flood zone. She said she has been in the house since 1972 and has never had problems during major storm events or water in the basement. Ms Jax said they are on the west side of the Fenton River and a discussion was held on the slope of the property.
The Commission agreed that they could not vote until the next meeting. Application was received tonight.
